Terms of Service

These Terms of Service (“Terms”) govern use of Yatishara Studio at studio.yatishara.com (“Studio”), owned and operated by Mercury Technologies (“Mercury Technologies”, “we”, “us”) in Trinidad and Tobago. By creating an account or using Studio, you agree to these Terms.

1. The service

Studio is a creative production platform for generating, storing, editing, and sharing media and related project work. Features may include AI-assisted generation, Academy courses, Creative Network listings/offers, messaging, and prepaid credits or subscription plans. We may change, suspend, or discontinue features with reasonable notice when practical.

2. Eligibility and accounts

• You must be able to form a binding contract and provide accurate account information.
• You are responsible for activity under your account and for keeping sign-in access secure.
• One person or business should not create accounts to evade bans, fees, or limits.

3. Plans, credits, and payments

• Prices are shown at checkout in the currency displayed (typically TTD). Taxes may apply where required.
• Payments are processed by our payment partners. Successful payment may unlock plans, credits, or course access as described at purchase.
• Prepaid Studio credits are a digital balance for use inside Studio. Credits are not cash, not transferable for cash except where we expressly provide a remedy, and may expire only if we clearly disclose an expiry at purchase.
• Subscription renewals continue until cancelled according to the cancellation controls in Studio / billing, subject to any disclosed notice period.

4. Refunds and redress

Our refund and redress rules for Studio credits and related purchases are designed to comply with Trinidad and Tobago consumer protections. In short:

• Change of mind after credits are successfully posted is generally not refundable.
• We will provide a refund, credit restoration, or other suitable remedy for erroneous/duplicate charges, credits paid for but not posted, material platform failure that blocks use, or a misdescribed offer.
• Nothing in these Terms excludes rights that cannot lawfully be excluded under Trinidad and Tobago law.

Request redress at hello@yatishara.com with payment reference and date. We aim to acknowledge within 3 business days and resolve within 10 business days when evidence is complete.

5. Your content and rights

• You keep rights in content you upload, subject to licenses needed for third-party material you include.
• You grant Mercury Technologies a worldwide license to host, process, display, and transmit your content as needed to operate Studio and features you enable (including sharing or public posts you choose).
• AI outputs may be imperfect. You are responsible for reviewing outputs before commercial use and for securing any model-release, trademark, or music rights your use requires.
• Do not upload or generate content you lack rights to use, or content that is illegal, abusive, or infringing.

6. Acceptable use

You agree not to:

• Break applicable law, including IP, privacy, deepfake, or advertising rules.
• Harass others, spam, scrape without permission, or attack Studio infrastructure.
• Circumvent billing, rate limits, access controls, or security measures.
• Misrepresent identity for seller / network KYC or payment fraud.
• Use Studio to create child sexual abuse material or other prohibited illegal content.

7. Third-party services

Studio relies on third parties (hosting, CDN, payment processors, AI model providers, email). Their terms and privacy policies apply to their services. We are not responsible for outages or policy changes by those providers beyond our reasonable control.

8. Disclaimers

Studio is provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant uninterrupted service, error-free generation, or fitness for a particular commercial campaign outcome.

9. Limitation of liability

To the fullest extent permitted by law, Mercury Technologies is not liable for indirect, incidental, special, or consequential damages, or lost profits, arising from use of Studio. Our total liability for a claim relating to Studio is limited to the amounts you paid us for Studio in the 3 months before the claim, except where liability cannot be limited.

10. Suspension and termination

We may suspend or terminate access for Terms violations, fraud risk, legal requirements, or non-payment. You may stop using Studio at any time. Provisions that should survive (including IP, payment obligations, disclaimers, and liability limits) continue after termination.

11. Changes

We may update these Terms. The effective date above will change when we do. Continued use after an update constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of Trinidad and Tobago. Courts in Trinidad and Tobago have exclusive jurisdiction, except where consumer law gives you mandatory rights elsewhere.
